Wittmer & Linehan Defend Car Crash Victim against Denial of Rightful Insurance Benefits
Distracted drivers pose real dangers for us on Florida roads. Unfortunately, distracted driving caused serious injuries to a client of Wittmer & Linehan PLLC. Jane Doe was heading east on Palmer Boulevard when a distracted driver attempted to turn left in front of her, despite the fact that she had a green light. Ms. Doe tried to avoid the other driver, but was unable to do so and struck his passenger side with a significant impact.
Ms. Doe sustained serious injuries requiring surgery and hospitalization. Despite the extensive medical care she received, Ms. Doe continues to deal with her injuries to this day and will be limited in her activities for the rest of her life.
Wittmer & Linehan was asked to co-counsel her case against the at-fault driver, as the at-fault driver’s insurance company, State Farm®, would not negotiate a reasonable resolution of her claim. After taking Ms. Doe’s deposition, State Farm® immediately resolved the claim for the at-fault driver’s full Bodily Injury policy limits, which was more than 10 times their original offer.
The focus of Ms. Doe’s case then switched to her Underinsured Motorist (UIM) claim with her State Farm® policy. Again, State Farm® initially made lowball offers to resolve her UIM claim. Wittmer | Linehan responded by filing a complaint with the State of Florida Department of Insurance regarding the actions of State Farm® in her UIM claim. To avoid a bad faith lawsuit following the filing of the complaint, State Farm® then agreed to pay Ms. Doe’s UIM policy limits to resolve her claim.
