Jane Doe was injured in a motor vehicle accident with an uninsured driver. Fortunately, Jane and her husband had made the prudent decision to include $25,000 of valuable uninsured motorist coverage when they purchased their auto insurance policy.
Jane received treatment from several doctors, and finally she was evaluated by a surgeon who recommended a cervical fusion for the injuries incurred in the accident. With the surgery she still needed, the total cost of Jane’s medical care was approaching $100,000.

Jane’s insurer refused the settlement offer. In their letter, they argued that all of Jane’s medical problems were related to “degenerative conditions,” and extended a counter-offer of $10,000. In response to the insurance company’s willful neglect of duty to their insured, we filed suit.
During the discovery process for this case, Wittmer & Linehan requested that the insurance company forward any medical evaluations to substantiate their claim that Jane’s condition was related to degeneration. Jane’s insurer did not possess any of these, having failed to submit her records to a medical doctor. Faced with the bleak prospect of an even larger judgment entered against them, Jane’s insurer settled the case with Wittmer & Linehan PLLC for a large six-figure sum.
